Digital-first institutions are being pulled into the same scam-liability perimeter as larger banks, but without the same teams, systems, or balance-sheet depth. The question is no longer whether they will be held responsible for scam losses, but how quickly they can investigate, evidence and remediate them when things go wrong.
Across APAC, that shift has moved from policy design to supervisory practice.
Singapore: implemented Shared Responsibility Framework, with a duty-based bank/payment-provider–telco waterfall for defined phishing scams
Thailand: implemented negligence-based cross-sector responsibility provisions spanning financial, payment, digital-asset, telco and platform actors
Philippines: implemented financial-sector conditional restitution and coordinated fund-holding framework under AFASA
Malaysia: implemented a financial provider compensation framework for unauthorised e-banking transactions, with broader sector coverage still developing
Australia: phasing in implementation of a cross-sector statutory prevention regime, with compensation/reimbursement being developed
Reimbursement or loss allocation frameworks also exist in New Zealand, India, Japan and China - with similar frameworks currently in development in Hong Kong and South Korea.
